Security Certificate and legislation applications

Necessary technical and administrative studies are performed and coordinated with the other public institutions for the purpose of minimising the effects of the stationary telecommunication equipment with respect to human health and environmental health and as a result the " Regulations Regarding the Determination, Measuring Methods and Inspection of the Limit Values of the Electromagnetic Field Intensity Arising from the Stationary Telecommunication Equipment Operating on 10 kHz - 60 GHz Frequency Band " is put into force by being issued in the Official Gazette dated July 12, 2001 and nr. 24460. The Notification determining the methods and principles of the Regulations is put into force by being issued in the Official Gazette dated September 09, 2001 and nr. 24518.
Within the scope of the Regulations, some innovations and peculiarities are brought forth to be applied in the process of establishment and operation of all kinds of stationary telecommunication equipment and systems - including the GSM Base Stations and Radio/TV transmitters- operating on 10 kHz - 60 GHz Frequency Band.

Limit Values
For the purpose of minimising the effects of the electromagnetic contamination in the human life; while determining the limit values, the limits of International Commission of Non-Ionising Radiation Protection (ICNIRP) are taken into consideration. (Limits of ICNIRO are; for 900 MHz 41 V/m, for 1800 MHz58 V/m). These are the values that are accepted by 42 countries including USA and member countries of the European Union. In our country, limit values that are accepted per equipment are approximately ¼ of the standard values which are 10 V/m for GSM 900 and 14 V/m for GSM 1800 and in this way 16 times more secure protection is provided. It was decided that the limit values should be applied on a lower level around health organisations in order to protect the medical equipment from incurring interference.

Security Range Definition and Security Certificate
Secure areas around the stationary telecommunication equipment and systems in which people can be present continuously and securely may be determined by using the limit values and Security Range calculation of the Regulations. Our Institution gives permission for establishing a stationary telecommunication equipment or system only if the places in which people are living are within the limits of a secure area. Since base stations have to be established in a cellular structure as required by their technical specifications, it is not possible to carry them out of the inhabited place.
Before the permission for establishing a stationary telecommunication equipment and system, the secure area is certificated with a Security Certificate that is arranged by our Institution. Later, after the establishment of the station, the Security Certificate is approved during the commissioning stage if, the technical measuring and controls to be performed by our Institution within the determined secure area are found to be in compliance with the provisions of the Regulations.
It is possible to let everybody know the secure area around the station by hanging the Security Certificate up to a place in the station that can be easily seen.
Possible negativeness will be prevented by means of the continuous inspections of the stationary telecommunication equipment and systems to be performed by our Institution within the framework of the Security Certificates.
In addition to the technical arrangements of our Institution, in order to provide the environmental criteria, opinions of the Local Environment Committees in the cities regarding the selection of the location are received while determining the locations at which the stationary telecommunication equipment and systems will be established.

Status of the Equipment and Systems that are Already Established and being Operated
Provisions of the Regulations are also in effect for the stationary telecommunication equipment and systems that are already established and being operated. For this purpose, latest by 01.07.2002 and with a Notification Change, it is necessary that the managers/operators shall put all of these into a state that provides the provisions of the Regulations and shall inform our Institution. The stationary telecommunication equipment and systems that are already established and being operated are also subject to the Security Certificate arrangement, approval and inspections.

Measurings
Measurings and controls pertaining to the Security Certificate are being realised by our Institution. However, "Measuring Authority Certificate" is being given to private individuals and corporate entities or institutions for the measurings that will determine compliance-noncompliance with the limit values that are within the scope of Regulations. List of the institutions that have received "Measuring Authority Certificate" is present in the " Certification" part of the "About the Institution" sub-section of the internet Web page www.tk.gov.tr. Realisation of Security Certificate application, measuring and control and inspections by our Institution are among the requirements of Regulations; besides, it is possible for our citizens to have their measurings done if they apply directly to our Institution or authorised people or institutions and pay its price.

Sanctions
A fine will be applied to the managers/operators of the equipment that is determined to be exceeding the limit values during the measurings and they will have set their equipment to the limit values within 5 days. If it is determined that the limit values are still not provided at the end of this term, activation of the equipment will be prohibited until the appropriate values are provided. In case the limit values of the environment are exceeded then the activation of the stationary telecommunication equipment that cause limit excess will be stopped for an indefinite period of time.

Statement of Reasons for the Change of Notification of Regulations and Performed Changes
In order to remove the problems that come out in the applications and as indicated above;
Change of Regulations is published in the Official Gazette dated 15.02.2002 nr. 24672 after some of its articles are changed and also Change of Notification is published in the Official Gazette dated 08.02.2002 nr. 24665 after some of its articles are changed.

- When technical specifications (output power, utilisation period) of all the stationary telecommunication equipment are taken into consideration, since the Electrical Field Induction values that will be formed in the environment by the equipment with low output powers are low and since this provides the
security range to be as short as it can be neglected, the stationary telecommunication equipment with output power 5 Watt or lower than 5 Watt -as indicated by the Institution in the system establishment permission- are put out of the scope however, the transmitter, transmitter/receiver equipment of cellular mobile systems and mobile transmitter, transmitter/receiver equipment that are used in a place to furnish telecommunication service for a temporary period of time are excluded.
- Because only 5% of the applications with all the required information and documents are completed within the given period of time especially by the public institutions (for example 35.000 ea equipment of Ministry of Forest) and GSM Operators that possess stationary telecommunication equipment and because the information and documents pertaining to the Security Certificate that will be given to the stationary telecommunication equipment related to the Private Radio and TV transmitters can not be provided through RTUK, a very short time before the date of 01.01.2002, the term is extended until the date of 01.07.2002 since the information and documents are decided to be requested by our Institution, Public Institutions do not have allocations that are separated for this service and there are different interpretations on the technical subjects that will be taken as basis in the applications.
- Antenna pattern in an electronically environment is not requested since it can not be provided.
- Form of "Stationary Telecommunication Equipment Information" that is in Attach: B of the Regulations are updated in the form of comprising the application evaluation information.
- Pursuant to article 28 of Law nr. 2813; Public Institutions and Institutions that are subject to license but not liable to a fee are also within the scope of regulations applications. Fee is not collected for the Security Certificate and the inspections that will be performed by the Institution but in case of any incompliance with the Regulations, provisions other than fine are applied in accordance with the relevant provisions of the Regulations.
- Dismantling -until 15.05.2002- of the stationary telecommunication equipment that are established within the gardens of Basic Education Institutions (pre-school, elementary and high school) is provided.

Result
By the Telecommunication Authority which carries out the duty of arrangement in the name of State for all kinds of wired or wireless telecommunication equipment and systems that have become important means in the utilisation of communication right and freedom; it is evaluated that with this Regulations, which is the result of the efforts on developing a just, competitive, qualified and secure legislation between the government and the consumer and manager/operator, expectations of the community are met and the Security Certificate application is a method that is sufficient and effective for the removal of the concerns of the public opinion.
